H-E-B Used SAPD To Violate, Disable Senior Citizen ADA Civil Rights

San Antonio, TX -- May 19, 2026 -- Minister Tyrone Merritt Sr., D.Div., a disabled senior citizen a resident of San Antonio Texas has filed a federal lawsuit accusing H‑E‑B Grocery Company, LP and their store manager Jake De La Cruz, of violations of the Americans with Disabilities Act (ADA) and discriminatory treatment at the H‑E‑B located at 999 East Basse Rd., Suite 150, San Antonio, TX 78209, The suit claims that Merritt, who was shot in the head over 35 years ago, was using a doctor‑prescribed assistive device for memory, as he has done ever since the incident in 1991. While shopping, he was approached by H-E-B store manager Jake De La Cruz, who questioned him about his body-worn camera. Despite Merritt repeatedly explaining on video that he had been shot and was wearing a medically prescribed ADA device, De La Cruz allegedly refused to provide reasonable accommodation as required by law, denied him access, and called the police with a false report that Merritt was "recording and making customers uncomfortable." The San Antonio Police Department CAD Report (SAPD‑2025‑1672793) confirms the manager's statement and shows that multiple police units were dispatched, despite no criminal conduct or disturbance by Merritt. "This wasn't just a misunderstanding -- it was discrimination," said Merritt. "Disabled people deserve dignity, not humiliation. I filed this lawsuit to protect my rights and the rights of every disabled Texan who shops at H‑E‑B." The U.S. Department of Justice Civil Rights Division has also logged Merritt's complaint under File No. 670502‑FZC, confirming that the matter raises federal disability‑rights concerns.
