That said, as a general matter, I always provide an honest prognosis of the chances of success for any prospective action, whether it be an initial filing, or a response. I am sorry if this can at times appear to be discouraging, but I do not lie to my clients about their chances, and I do my best to prevent clients from investing further funds into matters with a low chance of success without at least warning them of the low chances.

My trademark application was handled by this attorney, and unfortunately the process involved serious communication and follow-up failures. A critical USPTO deadline was missed, which resulted in the application being abandoned.
What is most concerning is that despite my phone number being on file, I was never contacted by phone regarding such an important and time-sensitive matter. Communication was limited to email only, and there was no clear or proactive effort to ensure I understood that missing this deadline would permanently cancel the application.
As a result, the application became inactive, and I am now being asked to pay again to reapply. In my opinion, this situation did not arise from my neglect, but from a lack of adequate follow-up, responsibility, and client communication.
For a trademark matter—where deadlines have irreversible consequences—I expected a much higher level of professionalism and diligence. Unfortunately, that standard was not met.

Multiple emails are sent in all matters, noting the deadlines. After an initial deadline is missed, there is a further followup message noting that the initial deadline was missed, providing the final revival deadline, and stating that "If the due date is missed, the application will be permanently canceled."
These messages are sent over the course of several months. It is unfortunately each client's responsibility to monitor their email inbox for messages from the firm. I do my best to repeatedly notify my clients of all deadlines and developments, but a failure to reply on the part of the client can and does lead to permanent abandonment of trademark applications, which does, in turn require a paid refiling in such cases.
